to the Uniform Dispute Resolution
Policy. In addition, domains registered through us are subject to the
Are You On The Web?, Inc. Registration
Agreement. Please make yourself familiar with the contents of
these documents, and agree to the terms.

B. This service may only be utilized
for lawful purposes; the usage of the service in connection with or adjunct
to any matter or thing which violates any municipal, state, or federal
statute or regulation is expressly prohibited.
C. Specifically, customer agrees
that no pornographic material, nor any material considered offensive, racist,
or unsuitable for audiences under 18 will be uploaded to the server.
Are You On The Web?,
Inc. explicitly does not allow the following:
nudity, pornography, sexual material,
hate propaganda or hate mongering, fraudulent material or activity; any
material that violates or infringes in any way upon the rights of others,
including, without limitation, copyright or trademark rights; any material
that is threatening, abusive, harassing, defamatory, invasive of privacy
or publicity rights, vulgar, obscene, profane, indecent, or otherwise objectionable;
or that violates any law or gives rise to any legal liability; material
that promotes, encourages, or provides instructional information about
illegal activities; any software, information, or other material that contains
a virus, corrupted data, or any other harmful or damaging component; any
raffle, contest, or game requiring payment of a fee by participants; sending
unsolicited email using an address hosted by AreYouOnTheWeb.
D. It is contrary to AreYouOnTheWeb,
Inc. policy for any user of our services to effect or participate in any
of the following activities through AreYouOnTheWeb, Inc. net-provided service:
NO Spamming - We are spam hostile!
1.To post a single
article or advertisement to more than five (5) Usenet or other newsgroups,
forums, email mailing lists or other similar groups or lists;
2.To post to any Usenet
or other newsgroup, forum, email mailing list or other similar group or
list articles which are off-topic according to the charter or other owner-published
FAQ or description of the group or list;
3.To send unsolicited
mass emailings to more than ten (10) email users, if such unsolicited emailings
provoke complaints from the recipients;
4.To engage in any
of the foregoing activities using the service of another provider, but
channeling such activities through a AreYouOnTheWeb, Inc. account or remailer,
or using a AreYouOnTheWeb, Inc. account as a maildrop for responses;
5.To falsify user information
provided to AreYouOnTheWeb, Inc. or to other users of the service in connection
with use of a AreYouOnTheWeb, Inc. service;
6.To use the AreYouOnTheWeb,
Inc name, or your AreYouOnTheWeb, Inc. hosted Domain / Email address (both
as a Reply to: and as the From: Header), or advertise your AreYouOnTheWeb,
Inc. hosted Website via Unsolicted Commercial Bulk Email as defined above;
AreYouOnTheWeb, Inc.
considers the above practices to constitute both abuse of our service and
abuse of the recipients of such unsolicited mailings and/or postings, who
often bear the expense. Therefore, these practices are prohibited by AreYouOnTheWeb,
Inc.'s terms and conditions of service. Engaging in one or more of these
practices will result in termination of the offender's account and
immediate termination of access to AreYouOnTheWeb, Inc. hosting services.
AreYouOnTheWeb, Inc.
reserves the right to implement technical mechanisms which block multiple
postings as described above before they are forwarded.
E. In addition to these activities,
this AreYouOnTheWeb, Inc. Terms and Conditions of Service also prohibit
other forms of abuse. This includes harassment and the posting of
illegal or unlawful materials. AreYouOnTheWeb, Inc. will respond
as appropriate to these activities as well.
F. Customer agrees to indemnify and hold
harmless AreYouOnTheWeb, Inc. from and against any and all claims, actions,
causes of actions, losses or damages (including legal fees) arising from
the usage by Customer of the service in violation of this Terms and Conditions
of Service agreement.
G. Unilateral Service Revocation:
In the event that AreYouOnTheWeb,
Inc. may at any time believe that the service is being utilized by the
Customer in contravention with the terms and provisions of Sections A,
B, C, or D above, AreYouOnTheWeb, Inc. may immediately discontinue
such service to Customer without liability, and without the refund of unearned
prepaid service fees.
H. Nothing contained in this policy shall
be construed to limit AreYouOnTheWeb, Inc. actions or remedies in any way
with respect to any of the foregoing activities, and AreYouOnTheWeb, Inc.
reserves the right to take any and all additional actions it may deem appropriate
with respect to such activities, including without limitation taking action
to recover the costs and expenses of identifying offenders and removing
them from the AreYouOnTheWeb, Inc. service.
I. In addition, AreYouOnTheWeb, Inc.
reserves at all times all rights and remedies available to it with respect
to such activities at law or in equity. |
